Immigration lawyers help immigrants navigate the stormy and treacherous seas of obtaining visas, becoming citizens, and transitioning to life in a new country. Immigration law is constantly changing. “Immigration laws and regulations can change often,” says Eric A. Shawar of Shawar Law. “Sometimes every year or even every 6 months depending on the issue.” In order to stay current with all the changes, immigration lawyers have to continuously study the law. “To keep up with the new rules, lawyers are constantly reading, attending conferences, and continuing their legal education,” explains Maria Norka Zagazeta Garcia of Zegazeta Garcia LLP.
When immigration law and regulations change, so does the process to immigrate. “New regulation changes in the immigration field impact not only future applicants, but also applicants that may have already applied for a benefit if the new regulation is retroactive,” says M. Zagazeta Garcia. This makes it even more important for immigrants to seek an immigration lawyer at the start of the process and work with them every step of the way. “There are very few lawyers with the expertise in immigration law, therefore not all lawyers are qualified in dealing with complicated immigration matters,” warns Shawar. If a client finds themselves in need of a lawyer to deal with immigration issues, they need to ensure they secure a reputable immigration lawyer.
Especially in today's global climate, it is becoming increasingly more difficult to immigrate to certain countries. “New immigration law arise based on the current public policies that are affecting Canada and worldwide,” explains M. Zagezeta Garcia. This means as global events and policies happen, it can affect the immigration laws in Canada. “New regulations can completely change who is eligible to apply to come or stay in Canada,” says Shawar. “New regulations often change the type of method people in need of immigration help will be able to become members of Canadian society.” One of the largest struggles affecting immigration and immigration lawyers in Canada is having the patience, time, and dedication to work with a client for years, in some cases. “You are assisting people in being granted privileges not rights, which is a much more difficult thing to do,” says Shawar.
Family lawyers deal with a wide range of family related issues, including divorce, child custody, common law marriages, and much more. Due to the nature of their work and clients, family lawyers must be more emotional intelligent than other lawyers. “A good family lawyer is trained to be sensitive to issues relating to the best interest of children and family violence,” adds George Lee of George Lee Law Corp, “Family clients are very emotional, and one party is always hurt or wants to get even with another party.”
For most clients, this is the first time they have gone through a divorce and as a result they will be very confused, hurt, and angry. “We have to educate clients about the family laws and rules,” says Lee. Family lawyers often deal with parents that have children and as time goes on, they are discovering better ways to peacefully resolve issues to minimize the impact on their children. “I often say to my clients: “You may win the fight, but may lose the battle.” I always encourage clients to settle their disputes outside of the courtroom to save family resources for their children,” Lee says, “In a lot of situations, the advice works miracles.” Probably the largest challenge for family lawyers is resolving conflict, while making their clients happy and minimizing the impact on the children. “I first deal with emotional issues with clients so that [they] can make better legal decisions in the process of litigation,” Lee says.
