SoniXCast Motion Granted by Hamburger District Court

The District Court (Landesgericht) Hamburg today granted a motion to hear accusations of unfair business practices being levied against, among others, the German PRO Gema and the German neighboring PRO Gvl

The District Court (Landesgericht) Hamburg today granted a motion to hear accusations of unfair business practices being levied against, among others, the German performance rights organization (PRO) Gema and the German neighboring performance rights organization (NPRO) GVL.

The hearing, scheduled for the 21 of August 2013, is the first of many motions filed to support the impending civil class action lawsuit of which SoniXCastâ„¢ is one of the plaintiffs. The legal team will be presenting recorded and written evidence gathered between January and June of this year in which representatives of both organizations actively coached competing businesses and private persons acting as agents to severely disrupt the plaintiffs business in Germany.

"The act of coaching businesses on how to terrorize (SoniXCast) customers constitutes a conspiracy under EU law. We already proved that case in front the European Parliament. With this motion we are merely requesting the German district court recognize the law as applicable in Germany and then we will move forward with formal charges." says SoniXCast CEO Brian Walton. He went on to say: "The negative propaganda hasn't hurt our business in Germany much, because we have been successful in dispelling the untruths, but it has caused our legal team to have to work harder in protecting our customers and that needs to be compensated."

When asked about filing criminal charges, Walton says: "We do not have enough evidence to support that. In order to file criminal charges, we would need to prove that the executive branch had knowledge of and/or actively took part in the propaganda activities. We do have enough evidence to sue for financial compensation however, although that may be limited by German law. We will get more money out of the individual claims against the perpetrating businesses and private citizens as we have more proof of their involvement."

When pressed for more details on the case, Walton says: "I've been instructed by our legal team to not disclose anything more than what has been prepared. Some of the plaintiffs in the case wish to remain anonymous and we don't have to make it easy for the defendants. I can say this: There are 3 major and 32 minor plaintiffs of which SoniXCast is the smallest company. Besides Gema and Gvl there are 2 government entities, 4 competing businesses and 12 private persons named in the complaint. I can't tell you when the complaint will be filed as that depends on how quickly we can get our motions passed in the German courts."
