Johnson & Johnson Hip Implant Lawsuits

Johnson & Johnson are facing thousands of lawsuits for allegedly manufacturing faulty hip replacement and hip resurfacing devices. The company recently offered a multi-billion dollar deal that is currently being reviewed by a federal judge.

Johnson & Johnson recently announced a multi-billion dollar deal in order to settle thousands of hip implant lawsuit across the country. This agreement was reached following discussions with the company and various lawyers of the patients that had to have their faulty hip implant replaced.

The company was accused of making hip implants that that were flawed and lead to multiple injuries and additional surgeries. Johnson & Johnson has agreed to pay any medical costs linked to the procedures. Some suggest that this could be almost $3 billion alone. With an estimated $250,000 to be paid to a typical patient for pain and suffering, this payout is expected to cost J & J billions of dollars. The product was pulled from the market back in 2010 when testing showed that the metal ball and socket product failed sooner than other implants made in the past. However, this was not until after thousands were used in patients and many people suffered from injuries and needed additional surgeries.

The suggested settlement was submitted to a federal judge on Tuesday. The settlement plan must be accepted by at least ninety four percent of people who are eligible for the claim. It is not certain that this settlement will pass or not. Some victims of the faulty product may want to seek additional money for damages and pursue their own private lawsuit.

For decades preceding this, all orthopedic hip replacements were made from ceramic or plastic. But roughly ten years ago, doctors started to favor hip implants that were comprised entirely of metal. This switch occurred because lab testing indicated that the devices would be much stronger and wear-resistant. Recent patient data indicated that the device are actually less reliable than older hip implants were. Now, full-metal hip replacements no longer seem to be the preferable option among surgeons.

Problems with the product were suspected to start early on and such claims were originally denied by Johnson & Johnson. Some patients suffered as a result of metallic debris created by the implant while others contracted serious pain and difficulty in movement until they received a new hip implant.
