YWCA Gardena Valley Has Abandoned It's Community & Forces a Legal Fight Between Board Members!
GARDENA, CA, February 10, 2016 (Newswire.com) - YWCA Gardena Valley located in Gardena, California is at a crossroads with the community, the YWCA USA organization, and in a legal battle over control of the building and an estimated donated funds of over $300,000, which has been frozen by the bank due to the suspicious and malice behavior of Jane Sunahara a terminated employee and a vicious battle of who is in control.
It appears that the President of the YWCA Major Lynette Jones had started to ask questions about the financial reports of the YWCA Gardena, which was governed by the Executive Director Jane Sunahara, and it was then when the YWCA Gardena started to have problems.
Major Lynette Jones was on a mission to receive funding for female veteran films and had applied for many grants and programs, as it seemed this may be possible, Jane Sunahara saw a different use for any funding that may come to the YWCA, thus starting an unlawful and vicious take down of Major Lynette Jones as President to not only be the governor of any and all donated funds, but to also avoid providing financial reports to the Board of Directors.
October 20, 2015, Jane Sunahara was terminated from her position as the Executive Director, of the YWCA Gardena Valley in Gardena, California. A Board of Director’s decision during a closed meeting moved to terminate Jane Sunahara as the Executive Director. Jane Sunahara refused to have a meeting with the Board President, Lynette Jones, in order to discuss the terms of her termination and furthermore had refused to leave the building.
After refusing to meet with the Board President to turn in her keys to the building, Jane Sunahara continued to occupy the building thus leaving Major Lynette Jones no choice but to go the courts to request a restraining order. The President went to the Torrance courthouse to obtain a restraining order against Ms. Sunahara in order to have her removed from the YWCA Gardena premises. On November 19, 2015 the police were called and Jane Sunahara was escorted off the premises. The restraining order was not granted at the time because Lynette Jones, the was not willing to lie and say that Ms. Sunahara was a violent person, however, the judge did grant a court date for December 9th. The restraining order was an effort to remove Jane Sunahara from the organization because she had refused to leave the building.
In retaliation from being removed from the building, Jane Sunahara on November 24, 2015 went to the Torrance Court House and was granted a temporary restraining order against the Board President, Lynette Jones by lying and stating that she felt Ms. Jones was harmful to her. With now a granted TRO full of calculated lies Jane rose to the occasion to call the Gardena Police, although Gardena Police officers on the scene understood the civil matter and had been involved in this battle for some time now, had no choice but to follow the court order and now remove Lynette Jones until the new court date of December 18th. During the time Ms. Jones was restrained from the YWCA Gardena Valley building, Jane Sunahara unlawfully broke into the building by cutting all the locks off the doors and with the help of another board member James Clark effectively disalarmed the ADT System from the outside to gain entry into the building in order to regain possession. The Gardena Police was informed of the unlawful entry but decided not to continue to get involved in what they called “a civil matter”.
Upon the advice of an attorney Ms. Jones dropped her lawsuit for a temporary restraining order against terminated employee Jane Sunahara. A restraining order is necessary when some type of violence has been committed or if a person feels endangered. Ms. Jones knew that Ms. Sunahara was not violent just defiant in the fact that she refused to leave and accept termination.
On December 18, 2015 Jane Sunahara and Lynette Jones went to court. Jane Sunahara asked the judge for a continuance. The judge denied her request because Ms. Jones had the right to a speedy trial and the right to be heard that day. Ms. Sunahara hesitated and was reluctant to move forward. The judge gave her three choices: one to proceed with the hearing, two to dismiss the case against Ms. Jones and the third choice was to proceed and let the judge make a decision. The judge asked Ms. Jones if she wanted to continue at a later date or move forward. Ms. Jones was prepared with substantial evidence to support the case that Ms. Sunahara brought against her. The judge explained to Ms. Sunahara the second time that she had to make a decision. She decided to drop the case against Ms. Jones. That seems strange for a person who claimed that the defendant, Ms. Jones, was violent and therefore feared for her safety. The restraining order was not warranted and was without evidence and merit. It is now 2016 and Jane Sunahara is still occupying the YWCA Gardena building as a terminated employee with the help of James Clark another board member, which most all other members have resigned. Why is another board member assisting Jane Sunahara in a take over of the building and funds, it was researched that James Clark has submitted a $50,000 proposal to Jane Sunahara for a close confident of his to renovate the YWCA Gardena Valley building, not to also mention that James Clark has just started a brand new Board of Directors consisting of only friends and family with many legal troubles including a pastor that had his non-profit license revoked from doing business with the State of California.
Several calls have been made to the YWCA USA in Washington, DC. They advised the YWCA board members that they cannot and will not get involved in the affairs of an independent Chapter even though they wear the name of YWCA. Jane Sunahara is 83 years of age and has had no supervision, no evaluations and no training for the past 8 years and has not had to produce any financial records or bank statements to any of the board members especially when the accountant for the YWCA is a family member of Jane’s and also refuses to produce financial records.
How do you get rid of a terminated employee who refuses to leave a position from which she has been terminated? There is a letter dated March 17, 2014, in which Jane Sunahara was terminated yet she still remains in the position. Why? Because she refuses to leave and no one has been successful in removing her. She has fabricated documents and conspired with other board members in order to further her own agenda. There is evidence of tax liens and mishandling of prior nonprofits in which lawsuits were filed. Board members are being selected based on relationships that were established by the Vice President of the board, James Clark. Members are not being properly vetted and there are public records available as to some of their prior mishandling and misappropriation of funds. Some of the new board members have had their non-profit status taken away and the Vice President has an $181,000 tax lien that is public record. Something has to be done about this public entity that is ineffective and doesn’t follow the bylaws. This organization is about helping women and children and no women and children are being helped.
What is the status of the organization today, Jane Sunahara continues to occupy the building as a terminated employee keeping the doors locked at all times so no one enters not even the public or any women and children in need of help. James Clark the Vice President of the YWCA Gardena Valley continues to assist Jane in trying to get the funds from the bank and continues to bring in friends and family to be board members as he violates all the non-profit laws of the State of California and violate all the Bylaws of the YWCA Gardena Valley which has been changed many times without notice to other Board Members. Currently James Clark has unlawfully kicked off every Board member that is not in agreement with him and Jane. Currently there is no legal Board of Directors at the location. The real Board of Directors is waiting for the court date to remove Jane Sunahara and James Clark to take back the building and help the community.
