Smith + Schwartzstein LLC Obtains $1.4 Million Settlement for Victim Struck by Car While Walking in Parking Lot

MORRISTOWN, N.J., June 21, 2019 (Newswire.com) - The Law Firm of Smith + Schwartzstein, LLC recently obtained a $1.4 million settlement for a 59-year-old Union County woman struck by a runaway vehicle in a parking lot in Summit, NJ.

On the afternoon of July 12, 2016, the plaintiff was walking in a Summit, NJ public parking lot on the corner of Woodland Avenue and DeForest Avenue when the defendant’s vehicle hit and severely injured her. Prior to striking the plaintiff, the defendant attempted to retrieve a parking ticket from the ticket machine located at the entrance to the parking lot. As a result, the plaintiff suffered permanent and painful injuries that required immediate surgeries, a lengthy stay in the hospital and subsequent stay in a rehabilitation facility.  

“The plaintiff lives with daily pain in her left shoulder, left and right hips, legs and lower back. As a result of the defendant’s actions, she had a total left shoulder replacement which resulted in muscle loss and limited mobility. She is unable to perform many of the daily tasks that she could previously perform and must tolerate pain on a daily basis. We feel this settlement will help her deal with her injuries and compensate her for her pain and suffering,” said Kathryn Schwartzstein, a partner at Smith + Schwartzstein LLC in Morristown, who represented the plaintiff.

The defendant’s insurance carriers are responsible for paying the $1.4 million settlement.
