One such trend is recent consideration by the Florida legislature, with the aid of insurance company lobbyists, to craft laws and policies so that new policies offer very little protection for consumers, yet insurance premiums continue to go up.

“Many people do not realize what their insurance policy provides protection for until they need their policy and find out about the many exclusions used by insurance companies to deny coverage,” said Joseph Maus, Managing Partner of Maus Law Firm. “For example, the insurance lobbyists recently asked the Legislature further restrict homeowner policies by requiring notice of a loss within 72 hours following the loss, even though some people do not realize they have an insurance claim within that time period.”

Another effort by the insurance lobbyists was to limit the amount of emergency restoration coverage your policy would cover. Emergency restoration includes water dryout, mold remediation, and emergency plumbing repairs following a loss. This new piece of legislation would limit emergency restoration service bills to a total of $2,500 despite their bills usually being much higher. Typically, emergency restoration bills can go as high as $10,000 depending on the severity of the loss.

A few years ago, the auto insurance companies successfully lobbied the Florida Legislature and got them to enact more restrictions on Personal Injury Protection (PIP) coverage.  Florida is a no-fault state, which regardless of who is at fault for the accident, your PIP covers initial medical bills, usually up to $10,000. 

However, in 2013, a new provision went into effect requiring a person injured in a car accident to be seen by a medical doctor and diagnosed with what is termed an “emergency medical condition”.  If the person is not diagnosed with such a condition, then their PIP coverage is limited to only $2,500. This is usually not even enough to cover your emergency room bill, or allow you to see a specialist following your accident.
