The case involved a 50-year-old undocumented Mexican immigrant who was changing a tire on the shoulder of the Grand Central Parkway, Queens, NY. The man suffered multiple injuries including a fractured femur, when a vehicle that lost control, allegedly due to black ice, struck him.
