Ajax Lawyer Daniel Barna Overwhelmingly Successful in Five Year Battle

Lack of evidence leads to favorable outcome. Despite a vigorous prosecution, there was simply no evidence to hold lawyer was involved with clients in money fraud. He was paid with tainted funds, he was exonerated.

Lawyer Daniel Barna of Ajax was overwhelmingly successful in his five year court battle.  In September of 2009 he was paid for services rendered by way of a bank draft.  The unscrupulous clients who gave him the draft did not tell him that the source of the funds was from proceeds obtained by crime. Barna was found after a seven week trial not to have known that the funds were obtained by crime and not to have participated in any of the transactions whereby the funds were to be distributed, that he had no part in, and was not part of, a cheque cashing ring which landed the main participants three and four year prison terms.  “They simply had no case against me,” Barna said.  

The prosecution erred at every turn.

Evidence at the lengthy trial showed that the Crown was at fault for the long delay in getting the case to trial, that the police misconducted themselves, and bullied witnesses.  Asked if he plans to sue, Barna said, “No comment at this time.”  It is, however, highly likely that he will sue, given his litigious history.  Barna is the guiding mind behind the Assaf estate litigation, the longest running case in Ontario, which has been before the courts since 1971.  His involvement in the case, he says, led to senior members of large firms taking a keen interest in him and having the Society commence numerous small proceedings against him. No dishonesty was ever alleged, let alone proven. He is on the road to having prior orders set aside, saying that many lawyer friends and colleagues are lining up to help. He claims to have been the victim of administrative bullies, but says the tide is now turning, and the way to deal with bullies is to fight them head-on.
