The Pareto Principle, often referred to as the 80-20 rule was suggested by management consultant Joseph M. Juran in the 1940s. The premise of this principle is that 80 percent of a quality problem can be tracked back to 20 percent of its causes.

The Pareto Principle, often referred to as the 80-20 rule was suggested by management consultant Joseph M. Juran in the 1940s. The premise of this principle is that 80 percent of a quality problem can be tracked back to 20 percent of its causes. Keeping this in mind, a recent study published by the New England Journal of Medicine found that a surprisingly small number of physicians have generated a disproportionate percentage of malpractice claims that have been settled with victims.

The study showed that certain specialties are more apt to have malpractice claims. However, more importantly, it also showed that once a physician has had one paid claim, the likelihood increases that they will have more. For example, only 1 percent of all doctors were responsible for 32 percent of all malpractice claims paid out between 2005 and 2014. Out of that number, 84 percent had just one claim, 16 percent had two paid claims, but 4 percent of these doctors had three or more claims against them.

What do these numbers mean? Howard Ankin, a Chicago medical malpractice lawyer explains, “While it is evident that some areas of medicine expose both doctors and their patients to a higher level of risk, it does not mean incidents of medical negligence should be excused. The public needs to be wary of doctors with multiple malpractice cases, regardless of their specialty.”

“The problem many malpractice victims will find is that insurers will attempt to rush to settle malpractice cases. Which is often before knowing the full extent of the harm that has been caused by the physician? We advise our clients to never rush to settle, because it is not in their best interests.”

To that end, Ankin, owner and partner with Ankin Law Office LLC has been honored with a 2015 Litigator Award. This award is a powerful endorsement of his superior litigation achievement and further serves as a strong reason for Chicago residents to consider him when seeking a medical malpractice lawyer.
