Appeals Court Reverses Landmark Receivership Decision
Online, January 27, 2014 (Newswire.com) - Jeff Baron is the former owner of domain-driven Onodva, LLC. After founding a philanthropic research trust to cure juvenile diabetes with his assets, Baron's relationship with his former partner turned sour. This turn of events has led to Baron's assets, and Baron himself, being forcibly placed into receivership. The Federal Court of Appeals disagrees with the rulings and has since overturned the receivership.
"What is frightening legally is the U.S. federal judge's reasoning. The judge reasons that he has power to - without any notice or hearing - appoint a receiver over an American citizen, and his receiver, who takes orders from the judge, can then waive the person's constitutional rights," said attorney Gary Schepps in speaking with World Net Daily. The receivership Baron was forced into has achieved nothing other than preventing Baron from hiring any legal counsel, a violation of his civil rights. Baron's attorney fees stemming from the receivership exceed five million dollars and the benefactors of this action should be investigated by the media. To date, Jeff Baron's notable case has been featured on LawInJustice.com, the Washington Examiner, and referenced on various legal advocacy blogs and websites. The Fifth Circuit Court of Appeals recently ruled that the order placing Baron and his assets into receivership was illegal and an abuse of discretion. However, Baron's fight is far from over.
