"How Cracking Down Cracked the System: The Detrimental Effects of Affirmative Consent"

These anecdotes were all made possible by the new "Affirmative Consent" policy and its implications: young adults are branded as sex offenders without a fair trial. It is not until their lives have been dragged through mud that they finally get their chance to speak up and be heard. By eliminating due process in these cases, universities are fighting terrible injustice with terrible injustice

The Amherst Rape Trial has garnered lots of attention as speculation into the 2012 sexual assault case increases. The plaintiff was a senior at Amherst when he was expelled after being found guilty for sexual assault. Today, he is claiming that his case was handled unjustly, and that there is plentiful evidence the school is refusing to address that could reverse his conviction. Amherst refutes, saying that the investigation was conducted in accordance with policy drafted by the Obama Administration. The President has made it a top priority to crack down on sexual assault on college campuses, often citing the popular statistic that 1 in 5 college women will be sexually assaulted at their schools. Many researchers have been intrigued by this 20%, and such inquiry has ultimately proved that these numbers are grossly overestimated.

Now, K.C. Johnson, Brit Hume, and other prominent icons are outraged by this injustice, and are advocating for past, present, and future victims of false accusation. Megyn Kelly attacked the new system, asking, "What is it about the administration or some who are so committed to protecting them that they are ready to throw young college aged men out the door with no thought to what their rights are, to what their future is like, innocent men in some cases?" This process leaves the faculty of the universities to play the roles of the police, the jury, as well as the judge. Without a legitimate hearing, one that is implicated cannot defend him/herself, and thus justice will never be achieved.

The Amherst Rape Trial is not the only case to expose the weaknesses of the new sexual assault policies that public universities across the country had to adapt. The University of Virginia rape incident, which involved public exploitation in Rolling Stone magazine, was ultimately found to be fabricated. Furthermore, Praise Martin-Oquike, a former football player at Temple University, was suspended from his team after being falsely accused of rape in May of 2012. The charges were dropped over a year later. These anecdotes were all made possible by the new "Affirmative Consent" policy and its implications: young adults are branded as sex offenders without a fair trial. It is not until their lives have been dragged through mud that they finally get their chance to speak up and be heard. By eliminating due process in these cases, universities are fighting terrible injustice with terrible injustice.

Unfortunately, the defenselessness experienced by accused sexual assailants applies to another set of victims as well. Within the Violence Against Women Act is written a provision that protects immigrants who are domestically abused by their American sponsor. Unfortunately, this form is now being exploited by alien criminals who want to bypass the immigration process. To put all of it into perspective, there are close to one million false domestic abuse accusations each year in the US, and it is estimated that tens of thousands of these are done against US citizens and permanent residents by their non-citizen spouses in order to gain access to the United States. This form of immigration marriage fraud is a major concern not only for the person who got deceived, but for the American society as a whole. It is a light of injustice and unfairness shining on the country best known for the individual freedom and liberty of its citizens, not to mention the threat to national security of our great nation. Victims of Immigration Fraud (VOIF), is working to raise awareness on this type of marital immigration fraud by lobbying congressmen and women and providing a support network for the victimized by this type of crime. Michael Parrotte, the founder of VOIF, became involved with these issues after researching Maryland’s House Bill 65 and Senate Bill 129, “unconstitutional twins, birthed by feminists” that violate the personal privacy that violates the personal privacy of American citizens.

VoIF Mission Statement: Our goals at Victims of Immigration Fraud are simple, yet challenging. We want to give guidance to those that have been victimized by deceptive foreign spouses, a broken immigration system, and an unfair judicial system. We also hope to prevent other American men and women from having to experience these injustices. We seek to redress the injustices that have been produced by unfair application of VAWA laws and the unfairness of the judicial system. We can be reached via our website www.voif.org, via email: voif.advocacy@outlook.com.
