Burnham Resources Reports: EAT Widens Obligation to Consult on Collective Redundancies

 Burnham Resources, an outplacement consultancy specialising in payroll jobs and payroll vacancies based in Egham, Surrey, has recently released a report about an important judgement: the Employers Appeal Tribunal (EAT) has ruled that employers’ obligation to consult over collective redundancies will now arise in any case where the employer proposes to close its workplace, rather than wait until the final decision.

The decision was the result of the case between the E Ivor Hughes Educational Foundation and Morris & Ors. The claimants were 24 members of the teaching staff at a private school. The number of students were declining and in February 2013 the school decided at a governors’ meeting that it would have to close at the end of the summer term if attendance had not increased by the following April. Numbers did not increase so the decision was made to close in April 2013 and the staff were made redundant without collective consultation.
