City of Upland Surrenders under Demand for Trial by Homeowner Accused of Criminal Conduct for City's Ordinates

Upland Throws in the Towel Rather Than Face a Jury in Brown Lawn Case

Demanding his day in court, Mr. Fernand Bogman’s criminal complaint by the City of Upland was dismissed against him on March 17, 2015 “In the interest of justice” at the request of Prosecutor Danny Peelman.

The ironic St. Patrick’s Day dismissal came as a surprise to Mr. Bogman’s attorney ,Michael P. Vollandt, managing atorney of Upland based Law firm Offices of Marc Grossman.  Vollandt had demanded his client’s rights be vindicated by his peers at a jury trial which had been scheduled for March 27, 2015.

Over the last year the City had demanded Mr. Bogman plead to a misdemeanor crime because he did not water his lawn causing it to turn brown and did nothing in the interim to hydrate his lawn. It was the rains that came early this year causing the law to turn green not Bogman.

Bogman a staunch supporter of the Governor’s fight against the drought, complied with the State’s mandates on water conservation only to be rebuffed by the City of Upland’s water guzzling administration instructing their prosecutor to file the criminal charges against him.

Bogman’s banner “a million dollars for defense, but not one penny for tribute” held true when the City realized it would be a jury not a bureaucrat that would arbitrate his rights...
